 What action can creditors take against me?

 

They Can:  

 

 

  • Contact by post or telephone you demanding payment
  • Increase the amount you owe by adding late payment charges, and also Charge you administration fees.
  • They can freeze your account so that you cannot use it anymore.
  • Issue a default notice, which be registered for six years or your credit rating
  • Use debt collection company's to chase payment
  • Threaten to take you to court.
  • Issue a County Court Judgment (CCJ) against you, which will also affect your credit rating?
  • Apply for an “Attachment of Earnings” order, which will deduct a weekly or monthly payment directly from your wages
  • Petition for your bankruptcy.

They Cannot:
 
  • Harass you with demands for payment in any such a way as to subject your family or household to alarm, distress or humiliation
  • Falsely represent that criminal proceeding will take place if failing to pay.
  • Falsely represent that they are authorised in a official capacity to claim or enforce the debt
  • produces a document falsely represented by them to have some official character of which they know it has not
 
Remember many activities could count as harassment, It is important to note that "anything done by a person which is reasonable" when trying to recover debt, Is not considered to be harassment.
